Woman accused of murder as a hate crime in NYC subway push death

NYC Subway Shove Suspect Sketch

By David Ariosto

NEW YORK (CNN) ? A 31-year-old Bronx woman has been charged with second-degree murder as a hate crime in the death of a man shoved in front of a subway train, Queens prosecutors said Saturday.

District Attorney Richard A. Brown identified the woman as Erika Menendez. She was arraigned late Saturday, where she was ordered held without bail and to undergo a psychiatric evaluation.

?(She) said in sum and substance ?I pushed a Muslim off the train tracks because I hate Hindus and Muslims ever since 2001 when they put down the twin towers I?ve been beating them up,?? the prosecutor said in a statement.

The victim, Sunando Sen, grew up in a Hindu family, his roommate said.

Witnesses said a woman paced the platform and talked to herself Thursday evening shortly before pushing the man as the 11-car train entered the station. The 46-year-old man?s body was pinned under the second car after it came to a stop.

The woman made ?statements implicating herself in the death of Sunando Sen,? Paul Browne, the New York Police Department?s chief spokesman, said earlier. Security video showed a person running from the scene.

Menendez was identified Saturday afternoon in a lineup, Browne said. She was recognized earlier in the day on a street in Brooklyn by a passer-by who called 911, the police spokesman said. The caller said she resembled the woman in the video.

?The defendant is accused of committing what is every subway commuter?s worst nightmare ? being suddenly and senselessly pushed into the path of an oncoming train,? said Brown, the district attorney. ?The victim was allegedly shoved from behind and had no chance to defend himself. Beyond that, the hateful remarks allegedly made by the defendant and which precipitated the defendant?s actions can never be tolerated by a civilized society.?

It was not clear Saturday evening whether Menendez had obtained an attorney.

Sen, of Queens, owned a shop called New Amsterdam Copies and was a graphic designer for posters, said roommate Ar Suman.

In early December, Ki-Suck Han, 58, was shoved onto the tracks in a Times Square station as a train approached.

Naeem Davis, 30, a homeless man, has been charged with second-degree murder in that case.

CNN?s Ross Levitt and Rande Iaboni contributed to this reported.

Forecast: Technology trends to watch for in 2013 ,Computer And You

Computer FutureThe biggest tech trends that were in news in 2012 were mostly concentrated in cloud computing technologies, mobile technologies (of which tablets popped like mushrooms in every other company!), social technologies, including many other small and big technologies. But, the year 2013 might bring in a bright year to many more technologies apart from the ones that had a great year in 2012.

The Consumer Electronics Association (CEA) has come up with the five greatest trends to watch for in 2013 and their list has,

  1. The future of 3D printing
  2. Next-generation TVs and displays
  3. The evolution of the audio market
  4. The mobile revolution in Africa, and
  5. Technology in education

Well, the list of trending technologies for the year 2013 given by CEA looks quite promising. Technology like 3d printing has evolved at a great pace with its mark in every other innovation by assisting in designing the products be it jewellery or mobile devices or even cars for that matter. Rather than creating physical models, virtual models created on computers offer great flexibility.

The quality of TV display has a great market indeed. People are getting tech savvy and are willing to replace older televisions with feature rich television.? LED?s, LCD?s and OLED TV?s are all running in the completion trying to improve and meet the quality demands.

The wireless headphones and the premium headphones that promise to deliver studio sound quality are only providing the basis for the CEA?s predictions. Adding to their analysis is the huge craze of people who are looking for professional sound quality in home audio systems.

As against the common beliefs about the gain in technological market in the continent of Africa, CEA predicts the rise of mobile revolution in the region. The trend has already been set in the continent as banking, business, and social networking have made good internet access in 2012 through mobile phones.

Since the inception of computer classes in schools years ago, the education system has seen several changes in the way pupils are being educated. The smart education system has replaced black boards and the new age tablets have started replacing books!

What I see is CEA?s predictions of trends to watch in 2013 coming true!

Apart from CEA, many giants in the field of technology and news have come up with their own list of trending technologies. According to a source on Forbes, the five trends include:

  1. Internet of things (IoT) which they believe to make a great hit in 2013.
  2. The trend of Big Data is the second one on the list where they are talking about the visualization and analysis on data that can help businesses.
  3. The cloud technology is here to stay in 2013 after leaving its prints in 2012.
  4. The issue of internet censorship and the enforcement of laws on the usage of internet is said to continue.
  5. The use and development in the field of multicore computing made the list too.

According to marketwatch, even the Verizon has identified hybrid clouds as one of the technologies that will continue to grow in 2013. Verizon is also talking about the mobile market and the security in IT sector as one of their identifications.

In various other sources the most talked about technologies that are predicted as trending in 2013 are social technologies, cloud computing, big data, technology in education and mobile technology. Though there is no much discussion on upcoming technologies in 2013, people are mostly involved in talking about the continuing trend which has already been set in 2012.

Which technologies do you think are going to stay in 2013? Do you believe if there is any chance of invention of yet another newer technology in 2013?

ReadWrite ? FISA Fail: Senate To Keep Spying On Citizens

In a blow to civil rights, and seemingly the Fourth Amendment, the Senate this morning voted to approve a bill that reauthorizes a foreign surveillance program that keeps tabs on peoples' emails and phone conversations, all without a warrant. While the whole country waits on pins and needles for the Fiscal Cliff to fall out from under us, this could be even more important, as our freedom of liberty is truly threatened, all in the name of national security.?

It's called FISA, the Foreign Intelligence Surveillance Act, and it's set up to allow the monitoring of U.S. citizens who speak with foreigners.?The vote extends the life of the bill for the next five years.?Since the House already gave the bill the thumbs up, it now goes to the President to get his seal of approval, which he is expected to sign.?

The problem is this basically gives the U.S. government carte blanche in spy-mode when it comes to eavesdropping on the communications of suspected terrorists. They don't need court approval now. They can just listen on the pretense that it makes our country safer from a possible terrorist attack. Of course, determining just who is a foreigner and figuring out their real or perceived "threat" to America is another problem in and of itself. On top of that, it's a lot of leeway and freedom for law enforcement and the government to listen in on the often mundane conversations between its citizens.?

Road Blocks And Detours

There's been some very real criticism of FISA, and it's even crossed normally staunch party lines.

The biggest detractors to the bill were Sens. Ron Wyden (D-OR), Patrick Leahy (D-VT), Jeff Merkley (D-OR) and Rand Paul (R-KY), all of whom wanted to protect the rights of people being unfairly monitored.

During the discussion session, Wyden point-blank asked if any U.S.-based email or phone communications were picked up by the government during surveillance of foreign targets to which?Senate Intelligence Committee Chairwoman Dianne Feinstein (D-CA) replied that those incidences were "few" and "inadvertent." In other words, yes, it has happened.

They proposed amendments to?extend the bill for three years instead of five, declassify FISA court opinions, and clarify that the Fourth Amendment protects U.S. citizens from intelligence-related searches done overseas. All three amendments were shot down.

Here's a full video of Wyden's impassioned yet failed attempt to sway the Senate:

Now What

Marc Rotenberg, the executive director of the Electronic Privacy Information Center, (EPIC), calls this a missed opportunity by the Senate to establish safeguards to Fourth Amendment rights and create much needed government accountability. Earlier this year, Rotenberg testified before a House judiciary Committee on this very issue. Yet the House didn't heed his words and voted the same way the Senate did today.

With the heavy risk of misuse and abuse, Rotenberg?calls FISA one of the biggest failures of Internet security, right there with?the Patriot Act.

"It's a very broad authority," he said. "Our view has been when you create broad authority for the government, you need to create counter oversight."?

Jim Fenton, the chief security officer at the digital identity company?OneID, has worked with intelligence agencies before. He says his experience included professionalism and good intentions, but warned that a lack of transparency with FISA, and rules that legislatures are confused with does not bode well for public perception of those groups.

"The government's lack of transparency about surveillance doesn't inspire trust," he said. "We should be working to differentiate ourselves from countries who aren't as free in terms of surveillance of its citizens."

That sentiment is shared online. In a post today by the Electronic Frontier Foundation, Trevor Timm?called Congress disgraceful.

"This vote was nothing less than abdication by Congress as its role as watchdog over Executive power, and a failure of its indepedent obligation to protect the Bill of Rights," Timm wrote. "The FISA Amendments Act and the ongoing warrantless spying on Americans has been, and will continue to be, a blight on our nation and our Constitution.?

So, where does this leave us now??

With the battle in Congress over, and the President expected to sign, the spotlight turns to the Supreme Court. In the next few months, the highest court in the land will pen an opinion on a case that highlights the problems with FISA:?Clapper Vs. Amnesty International, the ACLU's challenge to FISA, which will determine whether citizens will have the ability to sue the government in cases of unlawful surveillance under FISA. The opinion is expected by summer 2013 and will set a precedent if people can go to court to bring these challenges.

"We've got out fingers crossed," Rotenberg said. "There has to be more public accountability."

In fighting gangs, US should look to El Salvador

In combating the MS-13 gang, the Obama administration should look to El Salvador, which has adopted a far less confrontational approach, and is seeing a drop in gang violence as a result. A negotiated 'truce' with gangs is possible in the US and Mexico.

By Mike Honda and Ami Carpenter / December 28, 2012

Victor Garcia, from Calle-18 gang, sits with his wife and daughter during a religious service at a prison in Quezaltepeque, on the outskirts of San Salvador June 16, 2012. Mr. Garcia, along with members of the rival MS-13 gang, entered an unprecedented, negotiated truce that authorities say has greatly reduced the homicide rate.

Ulises Rodriguez/Reuters/file

In October, the US Treasury named the notorious MS-13 gang a transnational criminal organization. This unprecedented action aims to sanction the violent American-born street gang and seize its estimated millions in assets ? profits gained through drug and human trafficking.

But the Obama administration should take a cue from El Salvador, which has adopted a far less confrontational approach to gangs, and is seeing a drop in gang violence as a result. Both of us have worked and traveled extensively in Central America ? El Salvador in particular, which has its own MS-13.

In the United States, the MS-13 is made up of about 10,000 members, largely Salvadoran-Americans or Salvadoran nationals who fled El Salvador?s civil war. The US gang is part of a transnational criminal network of drugs, weapons, and violent gang culture.

In Central America, gang warfare has given way to a complex network of organized, violent crime and in many places has taken on characteristics of a ?traditional? war. Measuring the intensity of violence in terms of homicides, the so-called "northern triangle" of Guatemala, Honduras, and El Salvador is now considered the most violent region in the world (aside from battlefields), averaging tens of thousands of gang-related deaths annually. The need for suitable civilian protection is obvious.

The legal framework for civilian protection is international humanitarian law, which binds state and nonstate actors to rules meant to protect civilians in armed conflict. The International Committee of the Red Cross has argued that international humanitarian law is applicable when any ?war? amounts to armed conflict, defined by a certain intensity of violence: 25 to 1,000 war-related deaths per year and a sophisticated enough command structure that armed groups are actually able to implement such law. Clearly, the homicide figures in Central America far exceed the benchmarks for war-related deaths per year.

Earlier this year, in an effort to curb the violence, the government in El Salvador negotiated a groundbreaking deal with the Salvadoran MS-13 and a rival gang, Calle-18. In a bold move, mediators in El Salvador essentially extended the framework of humanitarian engagement to gang warfare, brokering a peace treaty between the two gangs and the Salvadoran government. After the deal, homicides decreased by 32 percent and kidnappings by 50 percent, as reported by The New York Times. In May, the gangs extended their truce to school zones and agreed to end forced recruitment of child soldiers.?

Gunmen in Yemen kill intelligence officer

SANAA, Yemen (AP) ? Two gunmen on a motorbike shot and killed an intelligence officer in southeastern Yemen on Saturday, security officials said.

The officials said that the officer, Mutea Baqutian, was on his way to work in Mukalla, capital of Hadramawt province, when the gunmen stopped his car and gunned him down, then fled.

The government has blamed al-Qaida militants for similar assassinations of several senior military and intelligence officials this year. The bullet-riddled body of Major al-Numeiry Abdo al-Oudi, deputy director of the security department of al-Qitten in Hadramawt, was found in the town's suburbs last week. He had been kidnapped earlier in the month.

The officials spoke on condition of anonymity according to regulations.

Meanwhile, Maj. Gen. Ahmed Seif, who is commander of Yemen's central military region, said the Defense Ministry has deployed an infantry brigade in the northeastern province of Marib to stop armed tribesmen who maintain cordial ties with al-Qaida from attacking oil pipelines and power generating stations, as well as to counter al-Qaida militants.

State TV meanwhile aired a meeting between President Abed Rabbo Mansour Hadi and eight Yemeni sailors who were rescued last week by forces of Somalia's semiautonomous Puntland region after being held for nearly three years by Somali pirates.

The Puntland government says that its forces captured the hijacked Panama-flagged MV Iceberg 1 on Sunday after a siege that lasted two weeks. They freed the eight Yemeni sailors together with five Indians, two Pakistanis, four Ghanaians, two Sudanese and a Filipino. The ship was hijacked March 29, 2010.

Hadi congratulated the eight sailors for their safety and ordered the government to compensate them for their suffering.

Eqbal Yassin, a relative of one of the freed sailors, told The Associated Press, that the hijackers had allowed some sailors to phone their relatives and convey the pirates' demand for $5 million ransom. He said he was told by his relative that the hijackers killed a Yemeni sailor who tried to escape. He gave no further details.

South Africa: Mandela rests at home

JOHANNESBURG (AP) ? The doctors treating former South African leader Nelson Mandela believe he should remain in Johannesburg for now to be close to medical facilities that can provide care to the 94-year-old, the government said Thursday.

Mandela left a hospital Wednesday evening after nearly three weeks of treatment there, and was brought to his home in the Johannesburg neighborhood of Houghton. The anti-apartheid icon, also known by his clan name, Madiba, has lived over the past year and more in the rural village of Qunu in Eastern Cape province, where he grew up.

"Where Madiba goes, in which period, in which times, is a matter that is entirely dependent on his own wishes. Whatever he wishes, we will do," presidential spokesman Mac Maharaj said in an interview with eNCA, a South African television news channel.

"But right now, the doctors have considered it necessary and good that he should be in Houghton so that he's close to all the facilities where we can give him high care," Maharaj said.

Mandela was admitted Dec. 8 to a hospital in the South African capital of Pretoria, 50 kilometers (30 miles) north of Johannesburg. The ex-president was treated for a lung infection and also had a procedure to remove gallstones.

"He is not yet fully recovered but he sufficiently moved forward so that he can be discharged," Maharaj said. He noted that Mandela had been in good spirits while receiving President Jacob Zuma and other visitors while he was hospitalized.

"Madiba was doing well, but as you know, when you're recovering there are ups and downs, slight ups and downs, and the doctors are looking for a steady progress and that began to be registered over the last few days," the spokesman told eNCA.

Mandela is revered around the world as a symbol of sacrifice and reconciliation, his legacy forged in the fight against apartheid, the system of white minority rule that imprisoned him for 27 years. The Nobel laureate served one five-year term as president after South Africa's first democratic elections in 1994.

Maharaj said Mandela is able to see his family "more easily" now that he is at home, but he appealed to the public to respect the former president's privacy "to allow the best possible conditions for his full recovery."

WASHINGTON: Shoppers disappoint retailers this holiday season ...

? U.S. shoppers spent cautiously this holiday season, a disappointment for retailers who slashed prices to lure people into stores and now must hope for a post-Christmas burst of spending.

Sales of electronics, clothing, jewelry and home goods in the two months before Christmas increased 0.7 percent compared with last year, according to the MasterCard Advisors SpendingPulse report.

That was below the healthy 3 to 4 percent growth that analysts had expected - and it was the worst year-over-year performance since 2008, when spending shrank sharply during the Great Recession. In 2011, retail sales climbed 4 to 5 percent during November and December, according to ShopperTrak.

This year's shopping season was marred by bad weather and rising uncertainty about the economy in the face of possible tax hikes and spending cuts early next year. Some analysts say the massacre of schoolchildren in Newtown, Conn., earlier this month may also have chipped away at shoppers' enthusiasm.

Retailers still have time to make up lost ground. The final week of December accounts for about 15 percent of the month's sales, said Michael McNamara, vice president for research and analysis at MasterCard Advisors SpendingPulse.

Still, this season's weak sales could have repercussions for 2013, McNamara said. Retailers will make fewer orders to restock their shelves, and discounts will hurt their profitability. Wholesalers will buy fewer goods and orders to factories will likely drop in the coming months.

Steep discounts weren't enough to get people into stores, said Marshal Cohen, chief analyst at the market research firm NPD Inc.

"A lot of the Christmas spirit was left behind way back in Black Friday weekend," Cohen said, referring to the traditional retail rush the day after Thanksgiving. "We had one reason after another for consumers to say, 'I'm going to stick to my list and not go beyond it.'"

Holiday sales are a crucial indicator of the economy's strength. November and December account for up to 40 percent of annual sales for many retailers. If those sales don't materialize, stores are forced to offer steeper discounts. That's a boon for shoppers, but it cuts into stores' profits.

Spending by consumers accounts for 70 percent of overall economic activity, so the eight-week period encompassed by the SpendingPulse data is seen as a critical time not just for retailers but for manufacturers, wholesalers and companies at every other point along the supply chain.

The SpendingPulse data released Tuesday, which captures sales from Oct. 28 through Dec. 24 across all payment methods, is the first major snapshot of holiday retail sales. A clearer picture will emerge next week as retailers like Macy's and Target report revenue from stores open for at least a year. That sales measure is widely watched in the retail industry because it excludes revenue from stores that recently opened or closed, which can be volatile.

In the run-up to Christmas, analysts blamed bad weather for putting a damper on shopping. In late October, Superstorm Sandy battered the Northeast and mid-Atlantic states, which account for 24 percent of U.S. retail sales.

Shopping picked up in the second half of November, but then the threat of the country falling off a "fiscal cliff" gained strength, throwing consumers off track once again.

Lawmakers have yet to reach a deal that would prevent tax increases and government spending cuts set to take effect at the beginning of 2013. If the cuts and tax hikes kick in and stay in place for months, the Congressional Budget Office says the nation could fall back into recession.

Shopping over the past two months was weakest in areas affected by Sandy and a more recent winter storm in the Midwest. Sales declined by 3.9 percent in the mid-Atlantic and 1.4 percent in the Northeast compared with last year. They rose 0.9 percent in the north central part of the country.

The West and South posted gains of between 2 percent and 3 percent, still weaker than the 3 percent to 4 percent increases expected by many retail analysts.

Online sales, typically a bright spot, grew only 8.4 percent from Oct. 28 through Saturday, according to SpendingPulse. That's a dramatic slowdown from the online sales growth of 15 to 17 percent seen in the prior 18-month period, according to the data service.

Online sales did enjoy a modest boost after the recent snowstorm that hit the Midwest, McNamara said. Online sales make up about 10 percent of total holiday business.

(AP) ? Rafael Nadal's return to competition has been delayed by a stomach virus.

The Spaniard was scheduled to play in an exhibition tournament in Abu Dhabi on Thursday after missing seven months because of tendinitis in his left knee. But he said on his Facebook page Tuesday that his doctors ordered him to pull out when he was running a fever, telling him his body needed rest.

"My rehab has gone well, my knee feels good and I was looking forward to competing," he said.

The 11-time Grand Slam champion hasn't played since June, when he lost to 100th-ranked Lukas Rosol in the second round at Wimbledon.

The injury prevented Nadal from defending his Olympic singles gold at the Olympics in London, where he was supposed to be Spain's flag bearer at the opening ceremony. He also had to pull out of the U.S. Open and Spain's Davis Cup final against the Czech Republic, which his teammates lost without him.

Top-ranked Novak Djokovic and No. 3 Andy Murray were also scheduled to play at Abu Dhabi.

Top Franchises For 2013 Reviewed On Empowered Ezine

SAN DIEGO, Dec. 25, 2012 /PRNewswire-iReach/ ? The wave of people looking for the?top franchises for 2013?is increasing daily. With more and more people leaning towards self employment and starting personal businesses due to the poor economy and not being able to rely on a job that may decide to downsize any day, the interest in franchise opportunities has understandably grown. According to the International Franchise Association, the Franchise Business Index has been steadily increasing since August and this is expected to continue as small business optimism increases for the New Year.

Franchises provide many benefits over starting a business from scratch. When starting a business from scratch, potential business owners will face many challenges. They will have to come up with a business idea that is profitable, as well as a comprehensive business plan and a way to market their business and gain brand recognition.

With a franchise, many of these business issues are already taken care of. The franchise will usually come with a ready to use business plan, with a product or service that is in demand and brand which many people will already know and trust. This brand recognition is what most people pay for when they buy a franchise.

One trend that many are seeing is the surge in interest people have had not only in traditional franchises such as fast food chains or convenience stores etc. but in online franchises. Part of the reason many of the?top franchises for 2013?involve some sort of online facet is the fact that the internet grants business owners access to the world wide market as opposed to the much smaller local market that could be reached through traditional business marketing practices.

There are many options when it comes to online franchises. The services and products that can be marketed are virtually endless. One thing that potential online franchise owners should look for is how much demand the service or product has for it, as well as how recognizable the company offering the product or service is.

Valpak Direct Marketing Systems Inc., Cybertary, Mini Cities Inc., WSI Internet, Results! Travel and Liberty Tax Service are all online franchises which have been ranked as some of the top franchises for 2013 by Franchise 500.

These online franchise businesses are also usually less costly to start up than offline franchises and this could be a deciding factor for many people. This means that business owners can start a business even if they have a small budget to work with or instead devote more of their finances to other pressing needs.

Another reason online franchises are some of the top franchises for 2013 is because many online functions can be automated. This means that business can be transacted even when the business owner is sleeping. This gives great potential for generating passive income, which continues to flow in even when the person is not actively engaged in working on or promoting the business.

These online businesses usually only rely on the person mastering a few simple online marketing skills. Learning these skills is easy, as there are many good?online resources, many of which offer this training free of charge.

Those who would like to avail of this free training can?click here. Those who would like to learn more about the franchise opportunities available in the new year can read the full?Top Franchises For 2013 review.

'Destroy the Picture' looks at destruction as form of creation | works ...

In the years following World War II, humanity was at a precipice.

The cities of Europe were still emerging from unprecedented bombing and near-complete destruction. The horrors of the Holocaust and the atomic obliteration of Hiroshima and Nagasaki were still sinking in.

"Concetto spaziale, Attese" is a 1958 aniline on canvas by Lucio Fontana. The artist slashed the canvas with parallel lines using a knife. On view at MOCA Los Angeles through Jan. 14, part of "Destroy the Picture: Painting the Void, 1949-1962."

And the specter of nuclear weapons and global annihilation hung over the world like a dark, suffocating cloud.

In this context, artists stared into the void and looked at destruction as a mode of creation. An exhibition at the Museum of Contemporary Art, Los Angeles, aims to document and explore this effort.

"Destroy the Picture: Painting the Void, 1949-1962" captures artists' literal assault on the picture plane. The group show is a fascinating collection of artists from the United States, Europe and Japan who ripped, cut, burned or affixed objects to the traditionally two-dimensional canvas and made it an undeniably three-dimensional space.

It's also former MOCA chief curator Paul Schimmel's final effort. Schimmel was unceremoniously let go from the museum in June, after 22 years at the helm of an ambitious and widely respected art program.

Schimmel's departure could be reason enough to see "Destroy the Picture," but it's the dynamism, diversity and strength of the art that are the main draws.

The exhibit features 85 works by 26 artists from the U.S., the United Kingdom, France, Germany, Austria, Italy, Spain and Japan. The selection of Japanese artists and their post-World War II work is something that hasn't been seen widely by American audiences. It's a rare and revealing peek into the Japanese psyche and culture during a time of demoralization and reconstruction.

Japan's Gutai group is particularly interesting and well-represented in "Destroy the Picture." The exhibition starts with a 1950 work by Shozo Shimamoto that's made of mixed media, newspaper, oil and soil ? demonstrating that he and other Gutai artists were willing to use all kinds of unconventional media in their art, including dirt. In fact, Shimamoto became known for hurling glass bottles of pigment onto a canvas ? a performative approach to painting that goes a step beyond Jackson Pollock's action painting. Shimamoto also painted on starched newspaper and punctured holes into the work with a pencil ? an accidental act that he turned into his modus operandi for a while.

Fellow Gutai artist Kazuo Shiraga (formerly of Zero-kai, or Zero Society) also has a number of pieces in "Destroy the Picture." He physically hung above his works from a rope and painted with his feet. The results are interesting but not astounding or aesthetically beautiful; in reality, "Inoshishi-gari 1 (Wild Boar Hunting I)," a 1963 painting on panel, is rather disgusting with its use of fur, paste and red paint made to look like blood and guts. Audiences found the piece repugnant when it was first exhibited in the 1960s.

Among the Gutai artists, other highlights are Saburo Murakami's red, peeling oil painting, "Sakuhin (Hakuraku suru kaiga)" from 1957; Shimamoto's "Taiho no sakuhin (Cannon Picture)" from 1956; and Chiyu Uemae's red paintings made of oil, wood and collage from 1958.

SIMILAR APPROACHES

Another element that makes "Destroy the Picture" worthwhile is the mixture of Japanese works among like-minded American and European achievements. Though the artists in Asia and Europe didn't necessarily know they were both puncturing and slashing the canvas, those similar and simultaneous movements are often represented at MOCA side by side, regardless of country of origin.

Near Shimamoto's works are those by American Salvatore Scarpitta, who used bandages in several works, as well as resin, aluminum paper, flex tubing, canvas straps and metal hardware.

"Moby Dick" (1958) is a composition consisting of cloth, bandages, wood, resin and paint that Scarpitta has impressively transformed to look like whale bone. "Sun Dial for Racing" (1962) and "Racer's Pillow" (1963) are physical works with straps and hardware separating sections of the canvas like a traumatized hospital patient.

Spaniard Manolo Millares' "Composition 9" (1957) is a paradigm of Schimmel's thesis of creation through destruction and filling the void with potentiality. Gaping holes in burlap are bridged by white string and accented by swirls of black paint. Though the piece looks like it's been thoroughly thrashed and strung back together again, the result is something new that goes way beyond the traditional two-dimensional oil on canvas.

American Lee Bontecou's untitled works from 1959 and the early 1960s are raw, emotive and sculptural. She uses canvas, welded steel, wire and other unconventional materials to create pieces that literally jut out toward the viewer. The deep, dark, oval holes are reminiscent of Edvard Munch's "The Scream" (1893), and her use of a saw blade in a 1962 untitled work adds a touch of danger and vulnerability.

French artist Yves Klein's untitled fire paintings were made with a blow torch, cardboard and female models dressed in fire-retardant clothing. Some look like they depict eggs, with dark pigment dripping around them. Here, both image and process are fascinating; it's worth noting that Klein died soon after he made these.

Performance has a lot to do with many of the works in "Destroy the Picture." For instance, Niki de Saint Phalle of France used to hold performances of her "shooting paintings." The artist would place plastic bags full of paint in front of a canvas, then shoot them with a .22 caliber rifle. While the result is interesting, I'm not sure if that kind of performance would fly today, in the wake of some tragic public shootings.

"Destroy" features several works by Argentine Lucio Fontana, who punctured his canvases with multiple holes and, most famously, slashed them in parallel lines with a knife. The slashed aniline-on-canvas paintings were revolutionary during their time (1958-59), but today, such an act seems somewhat commonplace ? either by the artist or by the art-hating misanthrope.

"Painting the Void" features a good deal of work that isn't pretty per se, but it's thought-provoking and representative of dark, uncertain times. It's one of those exhibits that underlines process and how that's a critical ingredient in the creation of art.

Schimmel's swan song opens a chapter in 20th century art history that's fascinating, engaging, occasionally repulsive and ultimately, profoundly educational.

Texas restaurant owner receives threats after Facebook comments on Connecticut shooting

Mourners listen to a memorial service outside Newtown High School. (AP)

The owner of Thai Noodle House in Austin, Texas has received threats after making a controversial Facebook comment about the Sandy Hook Elementary shooting in Connecticut.

Thailand-born Eddie Nimibutr wrote on his Facebook page Friday ?I don?t care if a bunch of white kids got killed. ?When kids from minority groups get shot , nobody cares.?

His initial post, which was deleted, can be seen in full at The Austinist.

Nimibutr?s rant was met with criticism and he claims to have received a death threat over the phone. He responded with the following:

?I am no fool to just feel and just believe the hypocrisy in our society the way everyone told me how to. Lots of people are mad at me for the thing I said. Some called with threat of violence. I laughed at the internet tough guys, but I reported to the police. I am educated and believe in my rights of the Freedom of Speech.?

The rest of his profanity-laced tirade can be read on his Facebook page.

After the backlash, Nimibutr said he will take a leave of absence posting on his Facebook: ?I think It?s time for me to get out of this city for awhile for a nice hike down south.?

A Small Home Improvement Project: Refinishing Our Original ...

E119F2AC 2867 4148 A501 B71DEBA6A783 518 000001BEC725E7D5 1 Small Home Improvement Project: Refinishing Our Vintage Bathroom Cast Iron tub

After Photo of our tub refinishing/ reglazing. The 1970s solid surface surround is visible in this photo.? I still like the streamline details on the side of the old tub.? Some of the new bathroom decor items can also be seen in this photo, including the cute little retro chrome and white trash can from Target.

This fall we decided to have our old 1944 white bathtub refinished by a professional tub reglazer.? It has been needing it for about five or six years.? When our kids were younger and still liked to use lots of tub toys, it seemed pointless to waste the money any sooner.? When we bought our house fifteen + years ago, the sellers unfortunately had the tub refinished just before listing the house and we didn?t realize it at the time.? In refinishing the tub, the old enamel was chemically etched so the epoxy would adhere, but it also permanently damaged the tub.? The tub looked great when it was first done, and it still did up until we had a toddler using the tub regularly.? With the tub toys, or anything for that matter, like a shampoo bottle being often left in contact with the tub surface, the tiny bit of moisture under the objects, slowly caused deterioration of the epoxy reglazing material.? Eventually it was full of chips in the finish.? Our tub looked absolutely terrible after about five years of regular use.? This is why most of the tub re glazing care instructions say to wipe down the tub after use and not to use any kind of non skid mats in tubs.? We got used to the unsightly tub, but it got so ugly, eventually the kids complained about how bad it looked and that it needed to be redone.

We didn?t want to go through the headaches and major expenses of redoing another bathroom just yet, at least not until the kids are a bit older, therefore, getting the bathtub reglazed/ refinished again, made the most sense to us, rather than ripping out the tub and starting from scratch.? The stripping of the old epoxy glaze was about $100 and the application of the new finish added another $300 to the expense.? It was not the cheapest quote we got, but the company had some of the better reviews on Yelp and AngiesList out of the local companies.

We tried to plan the tub?s refinishing for a time when it wouldn?t effect our lives too drastically.? The chemical stripping of the old ugly chipped glaze and resurfacing took about three hours from start to finish.? The workman was here at 9 in the morning and gone by noon.? He used a big tube that sucked out the smelly fumes outside while he worked.? Nevertheless, it was really stinky in the rest of house for most of the day, even with the door closed to the bathroom.? I am pretty sensitive to smells and really hated the off-gassing part. The care instructions said to not use the tub for at least 24 ? 48 hours and to make sure all water was cleaned up after bathing or showering for the first month after application.? The tub still had a chemical smell for a few weeks after it was done.? To avoid the chemical smell, we pretty much had to keep the bathroom door closed, unless we needed to use it, and we mainly used the other bathroom during that first month. I wish it didn?t involve the nasty chemicals, but there didn?t seem to be a good way to avoid them, other that not doing the project at all or completely replacing the tub.

We aren?t expecting this to be a permanent fix, but at least it will get us another half dozen years of decent looking use out of the tub, especially now that the kids are teens and no longer into tub toys or playing in the bath.? By time it is looking worn out again, I hope we will have forgotten about all the frustrations and hard work that went into our other bathroom and be ready for another big home improvement project.

About a year ago, I found a section of the seafoam green floor tile under the transition between the bathroom floor and the red oak floor in the hallway. ? When the time comes, we will likely return it to the original green with maybe an accent of yellow, similar to what was probably in the bathroom before the previous homeowners ripped it all out in the mid 1970s.? Sometime in the mid 70s they replaced the original bathroom tile with a beige marble looking solid surface tub surround, white counter top, and beige vinyl flooring.? It wasn?t very exciting or dramatic like 1940s or 1950s tile.? But for now, the tub does look much better than it has in a long time.

Since we were fixing up the tub surface, we also cleaned up the old chrome tub spout with a good soaking in vinegar and put in a new handle, new trim kit on the shower and handle, and new drain cover.? When everything was complete, my daughter, B, and I went shopping and picked out a new soap dispenser, a little retro looking pop up trash can, and towels, a bath mat, a shower curtain to match the soap dispenser.? B was really considerate, and didn?t pick anything too juvenile or girly that her teenage brother would totally hate.?? It isn?t an awesome vintage looking bathroom yet, but since this is my kids bathroom for the next half dozen years, it doesn?t have to be.? For less than $550 dollars, it looks like a nice new contemporary bathroom.? They really aren?t into retro decor, and they are pretty happy with the results of their bathroom.

Bobby Kotick Does Play Video Games - Game Informer

The New York Times recently published a large article about Activision CEO Bobby Kotick where he defends his appreciation for video games, and politely requests that people stop posting unflattering Photoshops of him online.

In the interview, Kotick says he has never been able to live down an article he did with Forbes in 2009 where he said he didn't play the video games he sold. He told the New York Times that he has blisters on his fingers from playing Defender back in the day, and these days he plays Skylanders with his daughter.

He also addresses the video game antagonist reputation he has won on the Internet. Kotick said, ?Think about what it?s like for my dating life when the first picture that comes up is me as the Devil.?

Regardless of your feelings about Kotick, you can't deny that the man seems to know what he is doing. His company has surpassed Electronic Arts as the world's largest and most profitable video game publisher.

HBT: Tigers still in play to get Anibal Sanchez

UPDATE: Per Nightengale, Sanchez?s agent says, ?He has not decided. Negotiations are ongoing..?

7:14 PM: Nightengale reports that the Tigers have bumped their offer to Sanchez. The specifics of the new offer aren?t yet clear, but it?s beginning to look like the Cubs got used for leverage here. This baseball is a tough business.

6:59 PM: Bob Nightengale of USA Today reports that the Cubs thought they had a deal with Sanchez, but the Tigers are being given the last chance to match. They previously offered him a four-year deal.

6:12 PM: Not so fast. Sanchez?s agent Gene Mato told CBS Sports? Jon Heyman that he?s still talking to other teams. Meanwhile, Heyman hears that the Tigers remain ?very much? in the mix to sign him.

Jon Paul Morosi of FOX Sports also hears that it isn?t a done deal, so stay tuned.

5:50 PM: Another unexpected signing. After a pretty general assumption that the Tigers were the favorites to bring back Anibal Sanchez, Bob Nightengale just reported that the Chicago Cubs have signed him. ?No official word on the money, but Ken Rosenthal had just previously tweeted that the Cubs were ?close? and were offering five years and $75 million.

Sanchez is a 48-51 career pitcher with a 3.75 ERA. Last year he?he had a 3.74 ERA for the Tigers and a 3.94 ERA for the Marlins and was 9-13 overall. He has thrown between 195 and 197 innings in each of the past three years.

He?ll immediately be the Cubs number one or, depending on how you feel about Matt Garza?s health, number two starter. And, considering where this market has gone so far this winter, that?s not a terrible price for the guy. ?I think most people figured he?d go north of $80 million.
